Bars and restaurants can win the safe harbor protection if all of the servers completed a TABC-certified training class where they learn to spot the signs of intoxication. The class is two hours long and can be taken online.
Although state law allows employees to be charged with a misdemeanor violation for serving an intoxicated person, records show the cases are few. The data also shows the safe harbor law has been a powerful and widely used defense. About 18 businesses in Texas successfully stanched penalties stemming from source investigations in the last three years – nearly as many as the 20 businesses that lost their permits.
In some fatal cases, police officers included in their reports the names of bars that served drunken-driving suspects, and no TABC investigation followed. Among the bars not investigated was the now defunct Centerfolds Gentleman’s Club, where 21-year-old Leslie A. Subirias had been trying out as a dancer in August 2006.

San Antonio Adult Entertainment: Ex-Teacher Blamed For Bizarre Smear Campaign

SAN ANTONIO — A former Northside Independent School District teacher is facing criminal charges tied to what police believe was a bizarre smear campaign against a man he saw as his love rival.
Among the list of charges filed against Lance Campbell, 39, are online harassment and attempted possession of child pornography.
A 24-page arrest affidavit detailed the case against Campbell.
It says that Olmos Park police became aware of the case in March when the victim began bringing them letters with his name and address on them.
The letters, made to appear as if they had been written by him, were sent to female escorts soliciting their services, as well as to day care centers, elementary schools and individuals, requesting pictures of young children.

Augustine Sauceda was sentenced yesterday after pleading guilty previously to killing 56-year-old Joe Ramon Junior in exchange for a maximum 30-year prison sentence. Defense attorney Joel Perez yesterday asked a judge to give Sauceda less than 30 years in prison because his mother was a prostitute and heroin addict. Sauceda had told police Ramon said he’d give him a ride home in 2009 but then groped him at his house, so he grabbed the knife to slash his throat.

The problem with taking a principled stand is that sometimes, in another context, it starts to look silly.
That’s what happened when Senate Republicans, long in the habit of pimping tort reform, set aside their concerns about runaway lawyering to let developers challenge a city’s determination of the value of trees — legislation one observer called the Attorney Welfare Act of 2011.
Another odd example, dealing with immigration, comes from Rep. Lyle Larson.
A consistent and eloquent advocate for smaller government, Larson, R-San Antonio, campaigned on bringing common sense to Austin. But he’s offered up a dog of a bill, HB 1553, under which any person or government entity providing a service would have to identify the citizenship of those receiving it, determine its cost, and send the tab to the person’s country of origin.
